ACA Marketplace Updates FAQs for 2027 Plan Year

The Affordable Care Act’s Health Insurance Marketplace has updated its frequently asked questions section, focusing on the eight most popular queries as of September 25, 2026. These FAQs, available in both English and Spanish, aim to clarify key aspects of the 2027 Marketplace plan year. The full set of ACA FAQs has been discontinued and will no longer be updated, with the new focus on these eight questions and their translations.

Understanding Premium Tax Credits

One of the central topics addressed is premium tax credits. These credits reduce the cost of most Marketplace health plans based on income and the local cost of coverage. The Marketplace calculates the expected contribution for a mid-range Silver plan, with higher-income individuals paying more and lower-income individuals receiving more assistance. The difference between the benchmark plan’s premium and the expected contribution determines the tax credit amount.

This credit can be claimed at the end of the year or applied in advance based on estimated income. If income is underestimated, the IRS may require repayment of excess credits when filing taxes. Conversely, if more credit was due, it can be claimed during tax filing. Reporting income changes during the year helps adjust credits and avoid significant repayments.

Eligibility and Income Requirements

To qualify for premium tax credits, individuals must have an income at least equal to the federal poverty level—$15,960 for an individual and $33,000 for a family of four in 2027. Eligibility is based on Modified Adjusted Gross Income (MAGI), and applicants must be U.S. citizens or lawfully present immigrants. Starting in 2027, eligibility for these credits will be restricted for many immigrant groups, with only lawful permanent residents and those under the Compact of Free Association qualifying.

Additionally, individuals must not be eligible for public coverage like Medicaid or Medicare and must not have access to affordable employer-based insurance. There’s an exception if the employer plan doesn’t meet the minimum value standard or if the employee’s share exceeds 10.22% of their income. Those with incomes below 100% of the FPL typically won’t qualify for these credits.

For those considering health insurance outside the Marketplace, ACA-compliant plans are available but do not offer premium tax credits. These plans, however, still cover essential health benefits and cannot discriminate based on pre-existing conditions. Non-compliant plans, while often cheaper, may exclude such protections and benefits. Signs of non-compliance include health-related questions on applications, lack of essential benefits, and annual or lifetime dollar limits.

Dependents moving out of state can remain on their parents’ health plan until age 26, though accessing in-network providers may become challenging. Such individuals might consider enrolling in their own plan through a special enrollment period, especially if moving outside the regular Open Enrollment period, which grants a 60-day window for new coverage. For personalized guidance, individuals are encouraged to consult HealthCare.gov or their state’s health insurance Marketplace.

Handling Health Insurance Outside the Marketplace

A photographer with non-compliant coverage might face limited benefits and higher out-of-pocket costs for pre-existing conditions. ACA-compliant plans outside the Marketplace are only sold during the annual Open Enrollment period or during special enrollment periods.
